If a <br /> container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it <br /> begins to leak,the owner or operator shall transfer the hazardous waste from this container to a container that is in <br /> good condition, or manage the waste in some other way that complies with the hazardous waste requirements. <br /> CORRECTIVE ACTION: Immediately transfer all hazardous wastes into containers that are in good condition. <br /> Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The following open hazardous waste storage containers were observed on-site: <br /> -One blue 55-gallon drum containing used paper filters located in the Tractor Shop. <br /> -One blue 55-gallon drum containing drained metal filters located in the Tractor Shop. <br /> -Two blue cylindrical containers containing used oil in the Trailer Shop. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste. Provide a corrective action statement and supporting documentation to the <br /> San Joaquin County Environmental Health Department within 30 days. <br /> This is a minor violation. <br /> 406 CCR 66261.7 Empty hazardous waste or material container greater than 5 gallons not managed per this section. <br /> OBSERVATION: Three black 55-gallon drums located on the North end of the property, behind the Maintenance <br /> Storage area were not marked as empty including the date they were emptied. <br /> REGULATION GUIDANCE: Empty containers which previously held a hazardous material, including hazardous <br /> waste must be managed per Title 22 California Code of Regulations(CCR)section 66261.7. Refer to this section <br /> and California Department of Toxic Substances Control guidance for more information. <br /> CORRECTIVE ACTION: Immediately label all empty containers with the date they were emptied and manage <br /> within one year of that date. Manage the container per Title 22 CCR section 66261.7.
