OBSERVATION: Two diesel cylindrical containers of approximately 500-gallons each and 1 rectangular container of approximately 150 gallons were found on site. Only 250-gallons of Diesel were reported to CERS. REGULATION GUIDANCE:Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, update the material quantity in the hazardous material inventory, and submit to the EHD for approval. -------------------------------------------------------------- OBSERVATION: The Hazardous Materials Inventory forms for all inventory materials were incomplete. -Hydraulic Oil was missing the fire code hazard, days on site and largest container size. -Motor oil was was missing the fire code hazard, days on site and largest container size. The storage information was reported as plastic/non metallic drum but the used oil was observed in an aboveground tank. -Lube oil was missing the fire code hazard, days on site and largest container size. -Acetylene was missing the DOT hazard class, days on site and largest container size. -Diesel was missing the days on site and largest container size. -Oxygen was missing the average daily amount, days on site and largest container size. REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a repeat violation, Class II. 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15.The business plan was submitted on 12/16/2021 for the year 2022. No business plan was submitted for the year 2021. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15.
