S A N J 0 A Q I I I Irl Environmental Health Department <br /> CCUN r <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> SINCLAIR/DING MART 3250 W HAMMER LN, STOCKTON July 18, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years from July 2019-2022 for all <br /> hazardous waste including the contaminated oily liquid in the 55 gallon black drum and metal fuel filters. Provide <br /> these records and a corrective action statement to the EHD within 30 days. <br /> This is a repeat violation, Class II. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years July 2019-2022 for all <br /> hazardous waste including contaminated oily liquid. Provide these records and a corrective action statement to the <br /> EHD within 30 days. <br /> This is a repeat violation, Class II. <br /> 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. <br /> OBSERVATION: This business did not provide a written response to the inspection report dated 5/26/2016 within 30 <br /> days. The report was delivered to the business on 5/26/2016. <br /> REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a <br /> written response to the department or the local officer or agency authorized to enforce this chapter pursuant to <br /> subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the <br /> department or the local officer or agency may reasonably require,which shall include a statement documenting <br /> corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for <br /> purposes of compliance with this chapter, or disputing the existence of the violation.
