OBSERVATION: Designated facility signed and dated copies of Uniform Hazardous Waste Manifests (UHWM) were not found on-site. The missing manifests are: -020390556JJK, ship date 11-14-19 REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest to the California Department of Toxic Substances Control (DTSC)within 60 days if the destination facility signed manifest copy is not received from the transporter or designated facility. CORRECTIVE ACTION: Locate the destination facility signed manifests listed above and maintain in the facility file for three years from the date of shipping. Send a copy to the San Joaquin County Environmental Health Department(EHD). This is a repeat violation, Class II. 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. OBSERVATION: This business did not provide a written response to the inspection report dated 5/26/2016 within 30 days. The report was delivered to the business on 5/26/2016. REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a written response to the department or the local officer or agency authorized to enforce this chapter pursuant to subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the department or the local officer or agency may reasonably require,which shall include a statement documenting corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San Joaquin County Environmental Health Department, requires response within 30 days. CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department. This is a Class II violation. Overall Inspection Comments: An inspection report was provided to the facility operator on the day of inspection. The report was amended and replaces the initial report. Violation #113 was removed and violation #110 was updated with the missing manifest. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, within 30 days of receiving the amended inspection report.
