OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic Substances Control (DTSC)database. REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. This is a repeat violation, Class II. 104 CCR 66262.34(d)(2)No modified contingency plan. OBSERVATION: Modified contingency plan information was not posted at the facility. REGULATION GUIDANCE: The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: Immediately post the modified contingency plan information or keep a copy of a complete consolidated emergency response/contingency plan on-site. Provide a statement to the San Joaquin County Environmental Health Department that the correction is complete. This is a repeat violation, Class II. 401 CCR 66262.34(d)(2) Failed to store hazardous waste in a container that is in good condition. OBSERVATION: Hazardous waste was found stored on-site in a container that is not in good condition. In the garden area, one blue 55 gallon drum (1/2 full)contained an unknown solid from the previous business. The drum had holes towards the bottom. Per Owner Hector Gonzalez,the waste is hazardous waste. REGULATION GUIDANCE: Hazardous waste shall be stored in a containers that are in good condition. If a container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it begins to leak,the owner or operator shall transfer the hazardous waste from this container to a container that is in good condition, or manage the waste in some other way that complies with the hazardous waste requirements. CORRECTIVE ACTION: Immediately transfer all hazardous wastes into containers that are in good condition. Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. This is a Class II violation.
