The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for J & L MARKET as of August 05, 2022. <br /> Open violations from May 23, 2022 inspection <br /> Violation#620-Failed to train personnel on all discharge prevention details listed in this section. <br /> OBSERVATION: It appears that the oil handling personnel were not adequately trained, as required.A leak was <br /> observed in the 10,000 gallon diesel aboveground storage tank during the inspection. Owner Karina Valdez was <br /> unsure on the steps to take to handle the release. Did not observe adequate training for Karina,the oil-handling <br /> personnel, regarding the following: <br /> -Discharge procedure protocols <br /> -The contents of the SPCC Plan. <br /> REGULATION GUIDANCE: (f)(1)At a minimum,train your oil-handling personnel in the operation and maintenance <br /> of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br /> regulations; general facility operations; and,the contents of the facility SPCC Plan. <br /> CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of <br /> the training log and training content to the EHD. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#705-Container not compatible with oil stored and/or storage conditions. <br /> OBSERVATION: Failed to use containers with material and construction compatible with material stored and <br /> conditions of storage such as pressure and temperature. The 10,000 gallon aboveground tank was observed <br /> leaking diesel fuel during the inspection from a hole in the tank. The tank is not compatible or adequate to store the <br /> product. <br /> REGULATION GUIDANCE: (c)(1)Not use a container for the storage of oil unless its material and construction are <br /> compatible with the material stored and conditions of storage such as pressure and temperature. <br /> CORRECTIVE ACTION: Immediately remove all oil stored in non-compatible containers. Store oil in containers with <br /> material and construction compatible with the material stored and conditions of storage such as pressure and <br /> temperature. Obtain properly constructed tanks that are third-party listed for use as Aboveground Storage of <br /> Combustible or Flammable Liquids. Ensure that the SPCC plan is adequate for the facility. Submit proof of <br /> correction to the EHD. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Page 4 of 6 <br />
