No business plan was submitted <br /> for the years 2020 and 2021. The business plan was submitted late for the year 2022. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year <br /> CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br /> annual HMBP to CERS by January 15. <br /> This is a minor violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> OBSERVATION: No training records for the last three years were available while on site. <br /> REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training.All employees shall be trained in safety procedures in the event of a <br /> release or threatened release of a hazardous material, including, but not limited to,familiarity with the following <br /> plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B)Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice,for the business site. <br /> This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br /> years. <br /> CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br /> training records to the EHD. <br /> This is a repeat violation, Class II. <br /> 12 HSC 25505(c)Failed to have the HMBP readily available to facility or EHD personnel. <br /> OBSERVATION: Employees do not have access to the Emergency Response Plan and the inventory information <br /> on-site. <br /> REGULATION GUIDANCE: The emergency response plans and procedures,the inventory of information required <br /> by this article, and the site map required by this section shall be readily available to personnel of the business or the <br /> unified program facility with responsibilities for emergency response or training pursuant to this section. <br /> CORRECTIVE ACTION: This was corrected on site. <br /> This is a repeat violation, Class II. <br /> FA0009619 PR0519777 SCO01 08/09/2022 <br /> EHD 19-01 Rev.9/16/2020 Page 3 of 4 Hazardous Materials Program OIR <br /> 1868 E.
