The San Joaquin County Environmental Health Department (LEA, <br /> 209-468-0343) and Code Enforcement offices (209-468-3184) reported that in 1989 a case (#EN- <br /> 89-168) was filed with the District Attorney's office regarding the illegal accumulation/disposal of <br /> waste on this property. The owner at the time, Leonard Lynch, claimed that he had not placed or <br /> allowed the placement-of the waste on his property. After legal action, the County of San Joaquin <br /> spent $70,000 to remove solid waste from this property (reportedly all of the waste was not <br /> removed from the property's southern boundary because the contractor did not know where the <br /> southern property line was located and believed that the solid waste left on-site resided on the <br /> adjacent Bill Lane Dump property). Because of some glitches in paperwork/legal processing, the <br /> owner (at the time Lynch) allegedly was not assessed for the cleanup and a lien was not placed on <br /> this property. During this time period, property ownership apparently changed through a foreclosure <br /> action. <br /> The LEA & Code Enforcement offices recently became aware that surface disposal activities have <br /> resumed at this location and requested 2136 staff to evaluate this site for possible site cleanup <br /> consideration on 5/27/98. <br /> REMARKS: This investigation was conducted in conjunction with the inspection of the adjoining <br /> property known as the Bill Lane Dump (39-CR-0001). Observations of the property were made property o <br /> South Santa Fe Road (along the property's eastern boundary) and from the Bill Lane Dump p p y <br /> (along the property's southern boundary). An on-site inspection will follow permission from the <br /> property owner to access the site. <br /> From the vantage points described above, a large amount (approximately 2,000 yd') of waste <br /> (construction/demolition debris, tires, appliances, landscaping, & household trash) was observed <br /> near and along the property's southern boundary. An area of waste was observed to have been <br /> placed on the side of the rail road berm, toward the property's southwest corner, apparently in <br /> readiness for landfilling activities. Access to the property for the purpose of discarding/disposing of <br /> waste is apparently gained by the use of two dirt roads that connect through the Bill Lane Dump. <br />
