w <br /> Richard Miller RECEIVED <br /> 196 Tiffany Circle <br /> Ripon, California 95366 SEP ® 8 2000 <br /> September 1, 2000 ENVIRONMENT HEALTH <br /> PERMIT/SERVICES <br /> RE: Property located at 23023 Santa Fe Road <br /> APN 249-060-14 10 Acres <br /> This is a written answer to the shutdown of all cleanup activity on August 4, 2000 <br /> and to the Robert Mc Clellon letter of August 16, 2000. <br /> In early July 2000, the three partners met with Robert Mc Clellon and one of his <br /> assistants at the Health Department of San Joaquin County conference room. This <br /> meeting was to talk about the next steps to be made as a result of the letter dated June 18, <br /> 2000 from Richard Miller. <br /> An agreement was made to dig five (5) sample trenches in this 80' by 450' strip <br /> of land against the railroad tracks. The purpose of digging the trenches was to establish if <br /> hazardous waste had been buried as some former extremist health department employees <br /> had said was possible. As Robert Mc Clellon stated, he was not concerned with any <br /> "class one"waste such as concrete, asphalt, wood, etc. He just needed a good sample of <br /> what was buried, and then we probably could make the property work. It would be <br /> foolish of us to spend any additional monies on the property in light of the original health <br /> department demands. The less invested in this property would make it easier for San <br /> Joaquin County to rescind the sale, because they could not deliver the use of the property <br /> with the title. <br /> Because of Robert Mc Clellon's commiiment, we spent a couple of thousand <br /> dollars digging trenches and continuing the surface cleanup. These sample trenches were <br /> extremely difficult to dig because of the larger pieces of concrete and stumps along with <br />
