to another Qualifying Entity designated by the County or to the County, acting as co - holder or backup <br /> beneficiary, until the County authorizes another Qualifying Entity . <br /> 94080 . 7 MONITORING , ENFORCING , AND REPORTING . <br /> ( a ) Monitoring and Enforcing . The Qualifying Entity shall monitor all agricultural mitigation lands and easements <br /> acquired under this Chapter and shall review and monitor the implementation of all management and <br /> maintenance plans for these lands and easement areas . It shall also enforce compliance with the terms of <br /> the conservation easements or other agricultural mitigation instruments . <br /> ( b ) Reporting by Qualifying Entity . Annually, beginning one ( 1 ) year after the adoption of this Chapter, the <br /> Qualifying Entity shall provide to the Community Development Department an annual report delineating the <br /> following . <br /> ( 1 ) Activities undertaken pursuant to the requirements of this Chapter and an assessment of these activities . <br /> ( 2 ) The status of all lands and easements acquired under this Chapter, including a summary of all <br /> enforcement actions . <br /> ( 3 ) Whether the in - lieu fee , in combination with other available funds , is appropriately covering its costs , <br /> along with indication of current fees . <br /> 94080 . 8 PRECEDENCE . <br /> This Chapter shall take precedence over all ordinances or parts of ordinances or resolutions or parts of <br /> resolutions with which it is in conflict . <br /> 94080 . 9 SEVERABILITY . <br /> If any section , subsection , sentence , clause or phrase of this Chapter is for any reason held to be <br /> unconstitutional , such decision shall not affect the validity of the remaining portions of this Code . The Board of <br /> Supervisors hereby declares that it would have passed this Chapter and each section , subsection , sentence, clause <br /> or phrase thereof irrespective of the fact that any one ( 1 ) or more sections, subsections, sentences , clauses or <br /> phrases be declared unconstitutional . <br /> Draft 8/ 10/22 <br /> Page 5 of 5 <br />
