1 purposes. Mr. Beard informed us that he had purchased the <br /> 2 properties and put them in his son' s names . He indicated that <br /> 3 it has caused him a certain amount of grief. Mr. Beard did <br /> 4 agree to maintain perimeter fence and to cover previously buried <br /> 5 waste. Mr. Beard agreed to fill all excavations and to grade <br /> 6 all low spots (See Attachment KK) . <br /> 7 uu. On May 13, 2002 Robert McClellon an employee of <br /> 8 the Environmental Health Department contacted Rodney Beard by <br /> 9 telephone and asked for site access to conduct a Phase II <br /> 10 investigation. I informed Mr. Beard that the Environmental <br /> 11 Health Department would send him the site access forms. I also <br /> 12 informed him I would have to seek an inspection warrant if he <br /> 13 would not allow access. Mr. Beard indicated that he would not <br /> 14 grant site access and felt that an inspection warrant would be a <br /> 15 better approach. <br /> 16 vv. On June 4, 2002 the Environmental Health <br /> 17 Department sent Bruce Beard a letter asking for site access at <br /> 18 the subject site and provided site access forms. The letter <br /> 19 asked that the form be signed and returned by June 24, 2002 . The <br /> 20 letter indicated that if the property owner did not respond by <br /> 21 that date it would be considered refusal . The letter was sent <br /> 22 Certified Mail (See Attachment LL) . <br /> 23 <br /> 24 ww.
