then left saying that he could be reached at the Escalon Fire Department. <br /> At 2:05 the Sheriff Deputy found me while I waited at Mr. Lane's residence. I explained what <br /> had Already taken place and that I intended to wait for Mr. Lane or his representative for up to <br /> half an hour to make a personal contact. I requested that the Sheriff wait on Santa Fe Road south <br /> of the property at 232001 S. Santa Fe Road to watch for Mr. Lane while I waited between Mr. <br /> Lane's residence and the property. While I waited, I attempted to phone David Irey to update him <br /> on the situation and left a message when no one in his office could be reached. <br /> At approximately 2:10, 1 was speaking on the cellular phone with Janet Keeter, Assistant <br /> Coordinator, San Joaquin County OES, updating her concerning the situation so that she could <br /> deliver a message to David Irey. A white male (approximate age of 23 years) driving a pickup <br /> truck stopped and identified himself as a friend of Bill Lane, and asked what I was doing there. I <br /> identified myself and explained that I was waiting for Bill Lane so that we could arrange for the <br /> fire to be put out. The gentleman said that he would contact Bill, and that his (the gentleman's, <br /> not Mr. Lane's) father would soon arrive with equipment to put out the fire. The gentleman left, <br /> and within five minutes Bill Lane approached my vehicle walking from the direction of his <br /> residence. Still on the phone, I stated out loud "Janet, I have to put you on hold" before placing <br /> the cellular phone handset on the dash faced towards Mr. Lane. I did not actually place Janet <br /> Keeter on hold, instead I hoped she would be able to overhear the conversation between Mr. Lane <br /> and myself. Later, Janet Keeter admitted that she could not hear any of the conversation. <br /> I introduced myself, gave him my business card and explained that complaints had been made <br /> concerning the fire and smoke on his property, and insisted that the fire be put out "today". I <br /> emphasized that if Mr. Lane was not able to put out the fire that afternoon, then the Fire <br /> Department would come in and do whatever was needed to extinguish the fire. For the first two <br /> to three minutes I listened while Mr. Lane spoke quickly and loudly using profanity to explain <br /> his situation. I sensed that a confrontation was imminent, and Mr. Lane seemed irritated by my <br /> presence. As he spoke he moved closer to me until our faces were less than one foot apart and I <br /> was backed up against my vehicle. Seconds later, I noted a complete change in Mr. Lane's <br /> behavior. He stopped using profanity, slowed his speech, lowered his voice and backed off to a <br /> distance of between two and three feet and asked, "Who called the Sheriff?" In my peripheral <br /> vision I saw that the Deputy Sheriff had just parked his vehicle to the south of my vehicle. I <br /> explained that the Fire Department requested a Sheriff be present if they had to enter his <br /> property and put out the fire. Mr. Lane said, "I don't want any trouble" to which I replied, "Me <br /> neither, we just want the fire out today." Mr. Lane said that he would put out the fire that <br /> afternoon using his Caterpillar tractor to smother the.fire with dirt, and if needed he would also <br /> use his water truck. Mr. Lane agreed to contact me later that day if he was not able to extinguish <br /> the fire or if the fire started again in the future. <br /> I sensed that Mr. Lane was uncomfortable around the Deputy Sheriff and noticed that he quickly <br /> walked back in the direction of his residence as soon as our converastion ended. I estimate that <br /> our conversation ended at 2:30, and at that time I explained the agreement that had been made to <br /> the Deputy Sheriff and asked if this area was part of his normal patrol. The Deputy replied that <br /> his patrol area was actually around Ripon and Manteca, so I released him from the scene and did <br /> not ask that he check Mr. Lane's progress later in the day. I decided to return to the OES office <br /> before meeting with David Irey. <br /> Between 3:30 and 3:45 1 received a phone call from Jim Cocco, complaining that the fire was <br />
