OBSERVATION: The emergency response(ER)procedures were lacking or inadequate. Section C-1 page 1 inaccurately state the local Unified Program Agency(UPA)phone number as 209 953 6200. The San Joaquin County Environmental Health Department UPA phone number is 209-468-3420. REGULATION GUIDANCE:A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to,the following: -immediate notification of local emergency personnel and the Environmental Health Department(EHD) -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment -evacuation plans and procedures, including immediate notice,for the site CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. -The 2021 business plan submittal was submitted late on 1/22/2021 -The 2020 business plan submittal was submitted late on 02/24/2020 REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Ensure that the business plan submittal are made annually by January 15 by logging into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This was corrected on site. This is a minor violation. Overall Inspection Comments: Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were two violations observed during the inspection, one violation corrected on site. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 09/30/2022. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
