ATTACHMENT TO COMMUNITY DEVELOPMENT DEPARTMENT <br /> VARIANCE APPLICATION <br /> Project Description <br /> The Project site, located on the northwest corner of West Lane and Alpine Ave in <br /> Stockton, CA, is zoned General Commercial and includes an existing 1.050sf retail <br /> building. <br /> The project site shares property lines with residences on the north and west property <br /> lines. <br /> Applicant is requesting a variance to reduce the setback from 20 feet to 12 feet on the <br /> north property line for two reasons: <br /> 1. Due to the growth of applicant's business since it was established almost fifteen <br /> years ago, Applicant's 1,050 sf retail building is too small to accommodate its inventory <br /> and office space needs for the conduct of its growing business. <br /> Accordingly, Applicant created additional space for inventory and office by placing two <br /> storage units on the property site that are non-conforming and must be removed. Liens <br /> have been placed on the property as a result of the non-conforming use. <br /> Applicant proposes to resolve the non-conforming issue by removing the storage units. <br /> and expanding the size of its existing retail building by approximately 682sf to <br /> accommodate the storage, inventory and office needs of its growing business. This <br /> would create an 8 foot encroachment of the north property line setback. <br /> 2. The additional retail space will allow Applicant to install an ADA compliant restroom <br /> for both employee and customer use. Presently, Applicant has an employee-only <br /> restroom which requires its employees to pass through a small office that contains <br /> valuable inventory, business records and proprietary information in order to access the <br /> restroom. Applicant must provide restroom access to its employees under Section <br /> 8394.4 of Title 8 of Cal/OSHA regulations. While Applicant trusts its employees, <br /> Applicant believes the better practice would be to eliminate the pass-through of its <br /> office/storage area to gain access to the existing restroom by providing a restroom for <br /> both its employees and retail customers in the expansion site. <br /> If the Variance is approved, Applicant is applying for Site Approval to expand the <br /> existing retail building and will obtain the necessary planning and building permits. <br />
