Because of the special circumstances applicable to the property, including size,shape,topography,location,or surroundings,the <br /> strict application of the regulation deprives the property of privileges enjoyed by other property in the vicinity and under identical <br /> zoning classification. <br /> Applicant is proposing to convert a non-conforming use into a conforming use by expanding the size of it's retail building to <br /> accommodate overflow inventory by removing non-conforming storage containers presently used to accommodate inventory <br /> overflow and office space.Varying the setback requirements wouid permit Applicant to request to convert the non-conforming <br /> structure to a conforming structure to be used in connection with Applicant's retail business.The property is zoned General <br /> Commercial which does not permit the storage containers presently being used to accommodate inventory overflow and <br /> need for office space. <br /> 2. The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations upon other properties <br /> in the vicinity and zone in which the property is situated. <br /> The granting of this Variance request will not constitute a grant of special privileges,in that this Variance request would allow an <br /> existing,non-conforming retail storage structures to be converted to a conforming retail operation under its current General <br /> Commercial zoning. In addition,any new structures would be required to meet the 20-foot setback requirement. <br /> 3. The Variance will not authorize a use or activity which is not otherwise expressly authorized by the regulation governing the parcel <br /> of property. <br /> The building expansion is incidental to the existing retail use: retail sales; the expansion of the building does not result in a <br /> change of use.The current use is retail sales.The proposed use is retail sales.The underlying Site Approval,which is required if <br /> the Variance request is approved, is to expand the existing retail facility for.the continued use of retail sales on site. <br /> Page 3 of 4 <br /> Updated 09/15/2020 <br />
