S0 JOA U 1 Environmental Health Department <br /> u ;� i I <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: T5O5 <br /> ty Address: Date: <br /> M&R CO S MAINST, LODI September 22, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br /> OBSERVATION: Kyle Martin stopped working for the facility last year and is still listed as the secondary emergency <br /> contact under the facility information in CERS.Also, he is listed in the facility emergency action plan in CERS as an <br /> emergency contact. The facility information section and the emergency action plans have not been updated with 30 <br /> days of the change. <br /> REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br /> information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material. <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d)Change business ownership <br /> e)Change of business name <br /> f)(1)A substantial change in the handler's operations occurs that requires modification to any portion of the <br /> business plan. <br /> (2)For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit <br /> immediate response during an emergency by either site personnel or emergency response personnel, or that could <br /> inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, <br /> or impede implementation of the business plan. <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at <br /> http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were two violations during the <br /> inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br /> statement documenting the corrective actions that have been or will be taken for each violation, and any <br /> supporting paperwork, by 10/22/2022. <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br /> ($156).
