SAN J 0 A Q I I I Irl Environmental Health Department <br /> C o u N T AMENDED <br /> 6/16/2022 <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> J &L MARKET 8115 S EL DORADO ST, FRENCH CAMP May 23, 2022 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 101 CCR 66262.12 Managed a hazardous waste without an identification number. <br /> OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control (DTSC)database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: Soil and concrete around the aboveground diesel tank were observed with heavy diesel staining. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean the areas contaminated with diesel. Manage the waste according to <br /> Title 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to <br /> the San Joaquin County Environmental Health Department describing the storage and final disposition of the <br /> cleaned up waste. <br /> This is a Class II violation. <br /> 303 CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br /> equipment. <br /> OBSERVATION: The secondary containment for the aboveground 10,000 gallon diesel tank was filled with <br /> approximately 8 inches of liquid. Diesel fuel was observed leaking from underneath the tank into the secondary <br /> containment. The liquid inside the secondary containment had a diesel odor. <br /> REGULATION GUIDANCE:All facility spill control equipment shall be maintained as necessary to assure its proper <br /> operation in time of emergency. <br /> CORRECTIVE ACTION: Bring the secondary containment into proper working order by removing the liquid in the <br /> secondary containment and placing in the proper waste container.
