The Closure Request includes the pertinent data, <br />summarizes the actions taken to investigate and cleanup diesel impacts to soil and <br />requests regulatory closure (No Further Action). Central Valley Water Board staff has <br />concurred with this request as provided in the enclosed Technical Memorandum. <br />During August 2019, APEX Envirotech, Inc. mailed a Central Valley Water Board fact <br />sheet to property owners adjacent to the Site. The fact sheet notified interested <br />persons of their opportunity to provide comments on the proposed No Further Action for <br />the cleanup. No comments were received during a 30 -day public comment period <br />ending on 31 August 2019. <br />Issuance of a No Further Action Determination does not preclude future action by the <br />Central Valley Water Board if subsequent monitoring, testing, or analysis at the site <br />indicates that the remedial action standards and objectives were not achieved; a new or <br />previously undiscovered release occurs onsite; new information indicates that further <br />site investigation and remedial action are required to prevent a significant risk to human <br />health and safety, the environment, or water quality; or the responsibly party induced <br />the Central Valley Water Board to issue this No Further Action Determination by fraud, <br />negligence, or intentional nondisclosure or misrepresentation. <br />KARL E.
