AOC site#:4912 <br /> Acquisition#:5445 <br /> immediately prior to commencement of the Work as is reasonably practicable, including but not <br /> limited to: (a) cause any excavations to be returned to the original gradient, (b) remove all <br /> equipment placed on the Property, (c) fill and level all ditches, ruts and depressions, if any, <br /> caused by the closure of the Licensee's excavation operations on the Property, (d) remove all <br /> debris resulting therefrom, and (e) restore any improvements (roadway, utilities, landscaping, <br /> tenant improvements etc.) to the extent altered, damaged or removed by the Work. This <br /> provision shall survive termination of this Agreement. <br /> This License is limited in purpose and scope to the least amount of access which is <br /> required to undertake and complete the Work and is not a lease and does not create any interest in <br /> the Property. This Agreement does not create a partnership,joint venture, or any other business <br /> arrangement or understanding between Licensor and Licensee. <br /> 2. Compliance with Laws =Licensee shall conduct all operations which are the subject of <br /> this License in compliance with all federal, state, and municipal statutes and ordinances, and with <br /> all regulations, orders, and directives of appropriate governmental agencies, as such statutes, <br /> ordinances,regulations, orders and directives now exist or provide. <br /> 3. Permits - Licensee, at no cost or expense to Licensor, shall be responsible for obtaining and <br /> maintaining any and all governmental permits and approvals which may be necessary for it to <br /> conduct any work or activities under this Agreement. Licensor shall coordinate and cooperate with <br /> Licensee in Licensee's activities to obtain all necessary government permits and permissions. <br /> 4. Additional Licensee Covenants-Licensee covenants and agrees to: <br /> a. Install all improvements in such a manner so as not to unreasonably interfere <br /> with motorists or cause an unreasonable risk of pedestrians tripping and <br /> falling, <br /> b. Deliver notice to Licensor at least seventy two (72) hours' prior to each entry <br /> onto the Property via email to Jack O'Sullivan, at osuljack@yahoo.com, <br /> which notice shall describe in reasonable detail the Work to be performed, its <br /> location on the Property,and an estimate of the duration of the Work, <br /> C. Licensor, at no cost or expense to Licensee, shall have the right to have a <br /> representative present during the performance of any Work at the Property, <br /> which representative shall cooperate with Licensee regarding safety <br /> requirements,concerns,and measures,as applicable. <br /> d. Control dust, noise and other effects of the Work and related activities, using <br /> appropriate methods customarily utilized in order to control the deleterious <br /> effects thereof,to the extent reasonably practicable, <br /> e. Minimize any disruption or inconvenience caused by the Work and related <br /> activities to Licensor, Licensor's business operations, and Licensor's tenants. <br /> The Work shall not unreasonably interfere with Licensor's or its tenants' <br /> access to or egress from the Property.Tenants occupy the Property from eight <br /> am to five pm,Monday through Friday. <br /> 2 <br />
