SAN J0,4 IN <br /> Environmental Health Department <br />Time In: 1040 am <br />Time Out: 11:35 am <br />COMPLAINT INSPECTION REPORT <br />Name of Facility MIGUELS Date: 07/27/2022 <br />Address: 7555 PACIFIC AVE, STOCKTON 95207 <br />Owner/Operator: HERRERA, MARIA Telephone (209) 951-1931 <br />Program Element: 1600 - FOOD PROGRAM Complaint #: C00055063 <br />Responsible Party Contact: <br />DESCRIPTION OF COMPLAINT ALLEGATIONS <br />The San Joaquin County Environmental Health Department received the following complaint: <br />COMPLAINANT ALLEGES THE EMPLOYEES ARE FORCED TO SERVE SPOILED STEAKS THAT HAVE ALREADY <br />STARTED TO TURN GREEN AND SMELL AND THEY LEAVE CHICKEN AND OTHER FOODS OUT ON THE <br />COUNTERS ALL DAY SOMETIMES. THEY ALSO ALLEGE THAT ONE OF THE CUSTOMERS TOOK A BITE AND <br />BECAME ILL SHORTLY AFTER. OWNER REFUSES TO THROW FOOD OUT THAT HAS WENT BAD. <br />VIOLATIONS AND CORRECTIVE ACTIONS <br />Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code commencing with section 7; <br />113700. All violations must be corrected within specified timeframe. Violations that are classified as "MAJOR" pose an immediate threat to public health <br />and have the potential to cause foodbome illness. All major violations must be corrected immediately. Non-compliance may warrant immediate closure of <br />the food facility. <br />#1 Demonstration of Knowledge <br />OBSERVATIONS: A food manager's certificate was not available during the inspection. Provide a copy of a valid 5 - year <br />food manager's certificate to lbaker@sjgov.org within 14 days. <br />CALCODE DESCRIPTION: All food employees shall have adequate knowledge of and be trained in food safety as it relates to their <br />assigned duties. (113947) Food facilities that prepare, handle or serve non-prepackaged potentially hazardous food, shall have an <br />employee who has passed an approved food safety certification examination. (113947-113947.1) Any food handler hired after June 1, <br />2011 shall obtain a Food Handler Card within 30 days (113948). <br />#7 Hot and Cold Holding Temperatures <br />OBSERVATIONS: The observed temperature on the three door Beverage Air display reach-in cooler and one door Victory <br />reach-in cooler was 43 F. Adjust units so that they maintain 41 F or below. Correct today. <br />CAL CODE DESCRIPTION: Potentially hazardous foods shall be held at or below 41/45°F orator above 135°F. Agustin Hernandez (Cook) was unaware of the complaint. No green, spoiled or <br />smelly meat observed on site. No out of date meat observed on site. Frozen chicken is stored inside one door reach-in <br />freezer. Freezer was in proper working order. Chicken is thawed inside the cooler.
