Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: COUMCKXZ1 Site Location: 6011 E PINE ST <br />Activity Summary <br />Activity Date Recorded by <br />05/17/2019 At 8:40am today I called Patrick Archibeque to follow-up on yesterday Complaint SAEED <br />and asked about the status of replacing the shaft seal on the pump. Patrick told me <br />the replace the ammonia system by a glycol system. Patrick confirmed that he <br />received a copy of the notice to abate and will be sending the documents to me. <br />Per discussion with Muni Naidu and Kasey Foley with EHD yesterday, they asked <br />me to refer Complaint (COUMCKXZ1) to Cal-OSHA by email. <br />I sent an email to Mostafa Nazi And Mathew Palmer with Cal-OSHA stating, "I am <br />referring the following complaint to you. <br />Yesterday at 8:15am, the San Joaquin County Environmental Health Department <br />received a complaint regarding an ammonia release (unknown amount) at All State <br />Packers DBA Rivermaid, 6011 East Pine Street, Lodi. I responded yesterday before <br />we met at Delta Packing and briefly discussed the incident with Mostafa. Initially I <br />was told there was no evacuation or exposure. When I arrived onsite, the ammonia <br />system was running, and asked the contractor to shut-off the system because the <br />leak was ongoing. The refrigeration contractor/ICR argued that the release is an <br />aqueous ammonia not anhydrous ammonia, and it is not hazardous. I discussed <br />with facility CEO, Patrick Archibeque that the release is hazardous, and the system <br />need to be shut-off immediately. The CEO asked the contractor to shut off the <br />system around 9:30am. The release was due a defective shaft seal on one of the <br />pump for the hdyrocooler system. When I returned to follow-up on the complaint <br />around noon yesterday, I was told that one employee complained of watery eyes, <br />and return to work without seeking any medical attention. I talked to Patrick this <br />morning and was told they replaced this ammonia system by a glycol system <br />yesterday. <br />All State Packers has two Anhydrous Ammonia Processes ( 7,200 lbs, and 5,600 <br />lbs). <br />Please feel free to contact me if you need any additional information or have any <br />questions." <br />At 12pm Mostafa called me and told me that there is not much he can do because <br />this is not a reportable incident, and no one was sent out for medical evaluation. He <br />told me he will discuss this farther with Management, and share the information <br />with OSHA PSM program to see if could qualify for the PSM program based on the <br />amount of ammonia oniste. <br />I shared my concerns that the contractors were trained on the hazard of the <br />ammonia. Mostafa told me he is probably going to call the facility and talk to them. <br />At 12pm Mostafa called me and told me that there is not much he can do because <br />this is not a reportable incident, and no one was sent out for medical evaluation. I emailed Mostafa stating, " <br />you will share the incident information with the PSM branch of OSHA.
