Richard Yoshikawa, Chairman <br /> San Joaquin County Board of Supervisors <br /> 222 East Weber Avenue <br /> Stockton, CA 95202 <br /> Re: Forward, Inc® Hazardous aste Disposal Site, Austin Road <br /> -Third Interim Report of Baier Agronomy, Inc. <br /> Dear Chairman Yoshikawa: <br /> We hand deliver to your office the "Third Interim Report t <br /> the San Joaquin Board of Supervisors Regarding the Activities of <br /> Forward, Inc. " by Baier Agronomy, Inc. , dated April 30, 1982. <br /> This responds to portions of Attachments No. 5, 6, 18 and 1 <br /> on Mr. Der ody's letter dated March , 1982. <br /> The enclosed findings show ries of substantial <br /> violations of "discharge specifications, monitoring provisions" <br /> of the California Regional Water Quality Control Board, Central <br /> Valley Regionj and thus are.., in turn, violations of condition no. <br /> 11 of the Use Permit. <br /> The enclosed also shows conditions which tend to be <br /> "injurious to health, safety or public welfare" , which are thus, <br /> in turn, a "nuisance" as defined in the Use Permit and a <br /> violation of condition no. 1 of the Use Permit. <br /> One of the hazardous waste evaporation ponds is 0800 times <br /> as permeable as the Regional Board's requirement. " (I do not <br /> mean 800%. I mean 800 times, which would be 80,000%. ) <br /> . Forward, Inc. 's denial of access to the site and to records <br /> in their possession greatly slowed the preparation of the <br /> enclosed report. <br /> The Monitoring Report of Forward, Inc. , due April 15, 1982, <br /> was not filed until two weeks late, so that it was too late to be <br /> discussed in the enclosed report. <br /> Respectfully submittede <br /> RICHARD IG, INC. <br /> 6 <br /> RICHARD W.
