quality problems exist at Forward, Inc. That letter was written <br /> without, apparently, a careful scrutiny of the records. <br /> The March 2 letter from Robert E. Fujii to Mr. C. E. Dixon <br /> is attached hereto as appendix D. In that letter, Mr. Fujii says, <br /> in part, "Our review—shows the discharger to be in general <br /> compliance.. .Forward's quarterly monitoring reports and our <br /> inspections have not indicated any water quality problems.. ." <br /> BAI has pointed out earlier that the violations of Discharge <br /> Requirements regarding the leachates in the trenches had escaped <br /> the attention of Mr. Fujii. But aside from that, the statement <br /> that Forward's quarterly monitoring reports and the inspections <br /> of the Regional Board.staff have not indicated any water quality <br /> problems needs some examination. First of all, the only hope <br /> whatsoever of detecting water quality problems from the Forward, <br /> Inc. reports would have to lie in the examination of the analyses <br /> of two monitoring wells. These are all that is left of six wells, <br /> and Mr. Stan Phillippe of the Regional Board staff informed BAX <br /> on April 16 that the staff of the Board considered these to be in- <br /> adequate. in other words, the reason that Mr. Fujii does not have <br /> any indication of a water quality problem is that he does not have <br /> any meaningful data of any kind, As for inspections, Mr. Fujii <br /> told SAX on April 16 that he had never visited the site, <br /> 4. Forward, Inc. has violated the Regional Board's requirement <br /> when the Grade I Trenches contain leachates, they shall be <br /> treated as Grade 1 wastes. <br /> item 6 of the Regional Board's Discharge Requirements for For- <br /> ward, Inc., under the heading "Discharge specifications"" says, <br /> "Group 1 waste materials and any water that has contacted the waste <br /> materials shall be contained in the area designated for Group 1 <br /> waste disposal." Also, the April 18, 1980 memo (attached as ap- <br /> pendix C)from Jim Parsons to Frank McDermott states,. under item 3 <br /> of recommendations. "Do not permit additional types of Group <br /> 1 wastes to go into these ponds until they have been reconstructed <br /> to meet minimum standards." In spite of that memo, and in spite of <br /> the Discharge Requirements, and in spite of the fact that the ponds <br /> 12 <br />
