APPENDIX C
RESPONSE TO KONIG LETTER NO. 8
AND BAIER REPORT
RECEIVED MAY 3 , 1982
The cover letter by Mr. Konig and the attached "report" by
Mr. Baier are erroneous and contain many incorrect and fallacious
statements. It is impossible (and, indeed, unnecessary) to
respond to all of these in the short time available. It is also
simply not necessary to respond to comments which are basically
of the "Have you stopped beating your wife yet?" variety.
Accordingly, our comments are confined to the four "Findings"
on page 1 of the report, and to some particularly egregious
technical comments.
(As an aside, we point out that judges made findings after
trial; quasi-judicial agencies make findings after noticed public
hearings : we are not aware that Mr. Baier is entitled to make
f indings 11 . )
#1 "In violation of the Regional Board' s requirement for
pond permeability in one case the pond is 800 times as permeable
as the Regional Board' s requirement. Based on the report it
appears that seepage has already allowed pollutants to enter the
groundwater system to ruin one year' s supply for 10,800 persons.
If not abated, this number could increase substantially.
