APPENDIX C <br /> RESPONSE TO KONIG LETTER NO. 8 <br /> AND BAIER REPORT <br /> RECEIVED MAY 3 , 1982 <br /> The cover letter by Mr. Konig and the attached "report" by <br /> Mr. Baier are erroneous and contain many incorrect and fallacious <br /> statements. It is impossible (and, indeed, unnecessary) to <br /> respond to all of these in the short time available. It is also <br /> simply not necessary to respond to comments which are basically <br /> of the "Have you stopped beating your wife yet?" variety. <br /> Accordingly, our comments are confined to the four "Findings" <br /> on page 1 of the report, and to some particularly egregious <br /> technical comments. <br /> (As an aside, we point out that judges made findings after <br /> trial; quasi-judicial agencies make findings after noticed public <br /> hearings : we are not aware that Mr. Baier is entitled to make <br /> f indings 11 . ) <br /> #1 "In violation of the Regional Board' s requirement for <br /> pond permeability in one case the pond is 800 times as permeable <br /> as the Regional Board' s requirement. Based on the report it <br /> appears that seepage has already allowed pollutants to enter the <br /> groundwater system to ruin one year' s supply for 10,800 persons. <br /> If not abated, this number could increase substantially.
