Substantively polluting the ground water; and <br /> 2. Substantively in violation of (our) Board's requirements." <br /> The information you have provided to date contains no evidence that such <br /> a condition, in fact, exists. I assure you that if there is confirmed evi- <br /> dence of a pollution problem at the site, this office will take appropriate <br /> action to remedy it. <br /> As I explained to the San Joaquin County Board of Supervisors, the operational, <br /> problems and violations noted in our inspections have been minor. The Hazar- <br /> dous Waste Management Branch also came to this conclusion as expressed by Mr. <br /> James Stahler to the Board. You requested notification of the corrective <br /> actions taken. A copy of the report subi-iiitted by Forward, Inc. describing <br /> . those actions is attached. <br /> You also invite our comments on your calculations of the salt and water mass <br /> balance for the solar ponds. As You are aware, I'm sure, we requested Mr. <br /> Baier supply to us his complete analysis of that mass balance, including his <br /> assumptions and calculations. He refuses to supply that data except on a <br /> confidential basis. As we explained to Mr. Baier, because we are a public <br /> agency and because this information cannot be considered a "trade" secret, <br /> we cannot accept that condition. <br />
