Environmental Health Department <br />Underground Storage Tank Program Inspection Report <br />Date: <br />November 22, 2022 <br /> Facility Address: <br /> 800 E Kettleman Ln, Lodi <br /> Facility Name: <br /> ARCO 07049 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 304 CCR 2631(a); HSC 25290.1(c) Failure to construct, operate, and maintain primary containment as product-tight. <br />OBSERVATION: Approximately 2 cups of liquid was observed in UDC1/2 and 3/4, indicating a leak in the primary <br />containment. <br />REGULATION GUIDANCE: All primary containment for the UST system must be product tight. <br />CORRECTIVE ACTION: Immediately have a properly licensed, trained, and certified contractor repair or replace <br />the failed component(s), under permit and inspection of the EHD if necessary. <br />This is a Class II violation. <br /> 307 HSC 25290.1(c3), 25290.2(c3) Failure to keep water out of the secondary containment system (post-Jul 2003). <br />OBSERVATION: Liquid was found in the 87 STP, 87 fill, 91 STP and 91 fill sumps. <br />REGULATION GUIDANCE: Secondary containment shall be constructed to prevent any water intrusion into the <br />system by precipitation, infiltration, or surface runoff. <br />CORRECTIVE ACTION: Immediately remove this liquid, make a hazardous waste determination per Title 22 <br />hazardous waste regulations, and manage accordingly. Immediately contact a properly licensed, trained, and <br />certified contractor to address the water intrusion into the sump under permit and inspection of the EHD, if <br />needed. <br />This is a repeat violation, Class II. <br /> 318 CCR 2635, 2637.1, 2665, 2712 Failed to meet spill container requirements. <br />OBSERVATION: The 91 spill container failed when tested. <br />REGULATION GUIDANCE: All spill containers shall have a minimum capacity of five gallons and be capable of <br />containing a spill or overfill until it is detected or cleaned up. <br />CORRECTIVE ACTION: Immediately contact a properly licensed, trained, and certified contractor to repair or <br />replace the spill container under permit and inspection of the EHD. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 12/22/2022. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($156).
