2. The applicant may ask for other types of designated <br />wastes to be added to the new permit. The Waste <br />Discharge permit 89-148 issued by Central Valley Regional <br />Water Quality Control Board would allow additional waste <br />to be added with their approval. <br />The California Integrated Waste Management Board, which is the <br />governing body for solid waste in the State, has asked for a CEQA <br />review because of the permit increase in tonnage from 175 to 500 <br />tons per day and the type of designated wastes the facility intends <br />to deposit. We agree with this interpretation. <br />Our question to you is this. According to CEQA requirements our <br />agency would be the "lead agency" for the solid waste facility <br />permit as we are the issuing authority. However, if the change in <br />operation of the facility would require a change in the Use Permit, <br />or a new Use Permit, then the Planning Department may become the <br />lead agency. <br />Would you please contact us regarding your interpretation of CEQA <br />requirements, lead agency status, and the environmental review. <br />9 <br />
