Forward soon will <br /> submit to PHS its finalized forms and requirements regarding the proposed soils <br /> acceptance program. Dr. Igbene is in the process of revising them to conform to the <br /> above-discussed requirements and comments. <br /> Thus, it is our understanding that pursuant to agreement reached at the meeting, <br /> and subject to Forward's implementation of the finalized soils acceptance program, the <br /> following provisions of PHS's April 28, 1990 letter have been addressed and will not be <br /> applicable to Forward: Items 1, 2(A), 2(B), 2(D), 2(E), 3(A), 3(B), 4(D) and 4(E). <br /> Commencing the SWFP Revision Process. PHS has indicated that a CEQA <br /> evaluation process must be undertaken in connection with any needed revision of the <br /> SWFP. Forward has interviewed several CEQA consultants, and is ready to discuss <br /> with the County the selection of an appropriate consultant. PHS and Forward are <br /> waiting for a decision to be made as to which department within the County will serve <br /> as lead agency for the CEQA evaluation. <br /> PHS, as Local Enforcement Agency for the Waste Board, probably will issue a <br /> series of three notices and orders to Forward regarding the Landfill (or perhaps one <br /> notice and order, with two amendments, depending on administrative convenience). <br /> The first notice and order will set forth certain requirements regarding the Landfill's <br /> operation during the interim period that the CEQA evaluation process is being <br /> undertaken and the SWFP is being revised as needed. Such issues as maximum <br /> average daily volume of waste, maximum permissible peak daily volume of waste, and <br /> the required implementation of the proposed contaminated soils acceptance program <br /> will be addressed in the first notice and order. <br /> The second notice and order will set forth certain milestone dates regarding the <br /> CEQA process. This will be issued after a CEQA consultant has been selected and <br /> the County and Forward have had an opportunity to elicit realistic timeframe estimates <br /> from the consultant. <br /> The third notice and order will address permission to use contaminated soils as <br /> a daily cover material, based on the issuance of required regulatory approvals. <br /> I want to reiterate how appreciative Forward is that PHS took the initiative to <br /> assemble representatives of the various regulatory agencies. Forward is eager to <br /> exercise tighter controls over its contaminated soils acceptance process, with particular <br /> fAdoca\SuwanoVac\fwditr <br /> 0615% <br />
