Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />October 13, 2022 <br /> Facility Address: <br /> 15390 S HARLAN RD, LATHROP <br /> Facility Name: <br /> Sherwin-Williams #8523 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br />OBSERVATION: Records of employees refresher training for the past three years were not found on site during the <br />inspection. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel <br />receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a <br />release or threatened release of a hazardous material, including, but not limited to, familiarity with the following <br />plans and procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br />This is a Class II violation. <br /> 12 HSC 25505(c) Failed to have the HMBP readily available to facility or EHD personnel. <br />OBSERVATION: Facility could not provide the Emergency Response Plan and the inventory information upon <br />request./Employees do not have access to the Emergency Response Plan and the inventory information on-site. <br />REGULATION GUIDANCE: The emergency response plans and procedures, the inventory of information required <br />by this article, and the site map required by this section shall be readily available to personnel of the business or the <br />unified program facility with responsibilities for emergency response or training pursuant to this section. <br />CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were two violations observed during <br />the inspection. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a <br />statement documenting the corrective actions that have been or will be taken for each violation, and any <br />supporting paperwork, by 11/12/2022. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($156).
