Greenway-Hayden Loop, Suite 100 <br /> Scottsdale, Arizona 85260 <br /> RE: FINANCIAL ASSURANCE MECHANISM FOR THE BORREGO,FORWARD, INC., <br /> KELLER CANYON, OTAY SANITARY, RAMONA AND SYCAMORE <br /> LANDFILLS, FACILITY NOS. 37-AA-0006, 39-AA-0015, 07-AA-0032, 37-AA-0010, <br /> 37-AA-0005 AND 37-AA-0023, RESPECTIVELY <br /> Dear Ms. Apker: <br /> This letter acknowledges receipt of the letter dated July 31, 2000 sent by Kemper Insurance <br /> Company, which included Certificates of Insurance (Certificates)for the above referenced <br /> facilities. Financial Assurance Section staff reviewed the Certificates established for closure and <br /> postclosure costs. As a result of this review, staff finds that the Certificates do not meet the <br /> requirements of Title 27, California Code of Regulations(CCR), Division 2, Subdivision 1, <br /> Chapter 6, Subchapter 3,Article 2, section 22248. Section 22248 specifies the California <br /> Integrated Waste Management Board (CIWMB) requirements pertaining to a surplus lines <br /> broker if a surplus lines insurer issued the policies. <br /> If a surplus lines insurer is utilized to provide the insurance coverage, specific documentation <br /> regarding the qualifications of the surplus lines broker transacting the insurance needs to be <br /> demonstrated at the time the Certificates are transmitted to the CIWMB. Specifically,the <br /> surplus lines broker who transacted the insurance policies must be licensed as a surplus lines <br /> broker by the California Department of Insurance(CDI). In order to document that the <br /> regulatory requirement is met our procedures require, either: <br /> ➢ The surplus lines broker licensed by the (CDI) signs the CIWMB Certificate. <br /> (If the license is issued to a company, only signatures of endorsed agents appointed as <br /> surplus lines brokers are acceptable). <br /> ➢ If the CIWMB Certificate is not signed by the California licensed surplus lines <br /> broker,a letter signed by the California surplus lines broker who transacted the <br /> insurance coverage,providing the broker's license number and referencing the <br /> insurance policies and the covered solid waste facility,must accompany the <br /> Certificates demonstrated to the CIWMB. <br /> California Environmental Protection Agency <br /> Printed on Recycled Paper <br />
