Santa Fe Road in <br />Riverbank (Site), and required you to complete a 60-day public comment period. During <br />the comment period from 10 April and 14 June 2020, one comment was received from <br />the responsible party (RP) of the Barrera’s Market UST case located south <br />(downgradient) of your property, requesting that we defer closure of your case until they <br />have a chance to perform their own investigation on the Barrera’s Market property. In a <br />30 June 2020 letter, Board staff informed you that we agreed to defer closure of your <br />case until the Barrera’s Market investigation was completed. However, after a closer <br />look at the Site data with upper management and the fact that Barrera’s Market has <br />been unable to secure a funding source for their investigation with no foreseeable date <br />in the near future, we no longer find it reasonable to defer your closure. However, keep <br />in mind that as with all closures, if new data from the Barrera’s Market property or any <br />other subsequent data demonstrates to the satisfaction of the Central Valley Water <br />Board staff that the data you provided to this agency was not accurate and <br />representative of your Site conditions, your closure may be re-evaluated at that time. <br /> <br />As the required public comment period has been completed, Central Valley Water <br />Board staff request that you destroy all remaining Site wells, with the exception of <br />MW-7, which is proposed to remain for use as part of the Barrera’s Market investigation. <br />It is expected that Barrera’s Market will assume liability for this well as part of their case. <br /> <br />San Joaquin County Environmental Health Department (SJCEHD) maintains <br />jurisdictional permitting authority over well destructions in San Joaquin County. <br />SJCEHD also requires written Central Valley Water Board staff concurrence with a <br />proposed well destruction scope of work before granting well destruction permits.
