1 2_ Access to Lincoln Center. LPL shall provide the Trustee, and all other <br /> 2 persons involved in the Trust's performance of the Work,reasonable access to Lincoln Center to <br /> facilitate performance of the Work. LPL shall cooperate with the reasonable requests of the <br /> -1 Trustee in obtaining access for and on behalf of the Trust to perform the Work on the premises <br /> 5 of tenanls of Lincoln Center. <br /> G D. Commitments of San Joaquin County <br /> 7 1. County C000cration. The County will cooperate with the Work performed <br /> 8 bythc Trustand,without compromising the exercise of its indcpendentiudgment for theprotection <br /> 9 of the public interest, will use its best efforts to expedite consideration of Work-related issues <br /> 10 brought to the attention of County departments and agencies. The County and the Trust shall <br /> I 1 establish a mutually agreeable communications protocol to facilitate such cooperation. <br /> 12 2. Assistance with Disposition of Water. The County of San Joaquin shall <br /> 13 cooperate and assist, in good faith and to the maximum extent practicable, with the Trust's <br /> 14 handling or other disposition of all water extracted,managed or otherwise handled in performing <br /> 15 the Wort:so as to assure the availability of any proceeds to the Trust as provided herein above. <br /> 16 The obligation to cooperate and assist as provided in this Section D.2 shall not require the County <br /> I 7 of San Joaquin to incur substantial costs. <br /> 18 <br /> 19 VW.REMEDIAL INVESTIGATION <br /> 20 The Trust shall: <br /> 21 A. Remedial Investigation Workplan <br /> 22 Adopt, implement and complete in its entirety all Work specified in the existing <br /> 23 Remedial Investigation Workplan dated September 23, 1996,and as subsequently amended,and <br /> 24 entitled, "Work Plan for Environmental Investigation, Lincoln Center, Stockton. California, <br /> 25 Prepared by Levine*Fricke.." The Workplan requires the following: <br /> 26 1. Completion of a Remedial Investigation to fully characterize the nature and <br /> 27 the lateral and vertical extent of the Hazardous Substances at and <br /> 28 emanating from Lincoln Center, in the soil, the soil vapor, and the <br /> Page-24- <br />
