SLR understands that a <br />Master Lease Agreement (“Lease”) by and between Save Mart Portfolio Owner NLP CA LLC, a Delaware <br />limited liability company and Save Mart Portfolio Owner NLP NV LLC, a Delaware limited liability company <br />(collectively, “Landlord”), and Save Mart Supermarkets, a California corporation (“Tenant”) has been signed. <br />As stated in the Master Lease Agreement, the Tenant has agreed to perform certain environmental tasks <br />with respect to the Site, including a supplemental environmental investigation based on the findings in the <br />September 2020 Phase I ESA and the January 2021 Additional ESA. <br /> <br />Specifically, the Tenant has agreed to conduct a Supplemental ESA to better define the extent of impacted <br />groundwater and soil vapor affecting Tenant buildings. SLR also understands that Save Mart has requested <br />that SheppardMullin enlist a qualified consulting firm to perform this work. This Work Plan has been prepared <br />in accordance with current California guidelines; however, it will not be submitted to a regulatory agency <br />such as the Central Valley Regional Water Quality Control Board (CVRWQCB) for review and approval. <br />BACKGROUND <br />SLR performed a Phase I ESA of the Site, in conformance with the scope and limitations of ASTM Practice E <br />1527-13, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment <br />Process, in September 2020. The assessment revealed evidence of the following recognized environmental <br />condition (REC) in connection with the Site: <br />• One Hour Martinizing dry cleaners has been operating at the Site since at least 1989. The dry cleaners <br />used halogenated solvents until approximately 2014 when they converted to a halogen-free solvent. <br />The use of halogenated solvents over a period of more than 25 years represents the potential for a
