TRACY <br />CITY OF TRACY <br />333 Civic Center Plaza <br />Tracy, CA 95376 <br />Telephone: (209) 831-6400 <br />Fax: (209) 831-6439 <br />RIGHT OF ENTRY AGREEMENT FOR CITY PROPERTY <br />CAPITAL IMPROVEMENT PROJECT <br />BASIN 3A (CIP TBD) <br />Surland Communities, LLC ("Developer") is performing design and construction work on behalf of the <br />City on City -owned property: a portion of 12501 W. Valpico Road ("Property"). <br />City hereby grants Developer, its agents, employees and contractors, a license to enter upon <br />Property in accordance with the terms of this Right of Entry Agreement ("Agreement"). <br />Developer shall perform the following Work on the Property: <br />Design investigations: Geotechnical sampling and testing, surveying, boring and groundwater <br />monitoring, and biological surveying <br />Earth moving or construction is not allowed with this Right of Entry Agreement. <br />Developer's right to enter Property terminates on�yt�� �0 `Z�v2 . A representative from the City will <br />contact Owner prior to the commencement of the Work. <br />Developer hereby agrees to indemnify, defend, and hold harmless the City from any damage to <br />Property arising by reason of Developer's Work or Developer's entry on City's Property pursuant to <br />this Agreement. Developer further agrees to restore, as near as possible, the Property to its original <br />condition prior to commencement of Work. <br />City understands and agrees that after completion of the Work described above, City shall be <br />responsible for the maintenance and repair of Property. <br />SIGNED: <br />rlC\ /CI r1M <br />Rev.
