If a <br /> container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it <br /> begins to leak,the owner or operator shall transfer the hazardous waste from this container to a container that is in <br /> good condition, or manage the waste in some other way that complies with the hazardous waste requirements. <br /> CORRECTIVE ACTION: Immediately transfer all hazardous wastes into containers that are in good condition. <br /> Provide a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION: The following open hazardous waste storage containers were observed on-site: <br /> -One black 55 gallon drum on the south side of the storage area was observed with used oil filters without a lid. <br /> -One red 55 gallon drum in front of the 1000 gallon used oil tank was observed without a lid. <br /> -Three black 55 gallon drums in front of the 1000 gallon used oil tank was observed open and without a lock. <br /> -One oil filter drained container in front of the 1000 gallon used oil tank was observed open. <br /> -One black 55 gallon drum observed on the northeast corner of the warehouse was observed open. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste.
