OBSERVATION: The designated operator failed to check and note the correct test dates for the overfill prevention equipment inspections on the designated operator inspection reports. -The overfill prevention equipment inspection was performed on 11/20/2020 on only the diesel and 91 tanks. The 87 overfill prevention equipment was tested on 12/18/2020. REGULATION GUIDANCE: During the inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and document the dates they were done. CORRECTIVE ACTION: Ensure that designated operators performing inspections at this facility are including all of the required information on the reports. This is a repeat violation, Class II. 214 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION:According to work order#151527,the 87 fill sump sensor was replaced on 2/9/2022 and the EHD was not notified. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD. A"Failure to Obtain a Permit"penalty applies. This is a minor violation. 306 HSC 25291(e)Failure to remove, analyze, and properly dispose of water in secondary containment(pre-Jul 2003). OBSERVATION: Liquid was observed in the 87 fill sump. REGULATION GUIDANCE: If water could enter into the secondary containment by precipitation or infiltration, it must be removed and disposed of properly. CORRECTIVE ACTION: The service technician removed one gallon of liquid from the 87 fill sump. Ensure that all sumps and annular spaces are maintained free of liquid. This is a Class II violation.
