OBSERVATION: The Facility Employee Training Certificate dated 1/24/2023 was not signed by the designated operator. REGULATION GUIDANCE:All site employees must be trained prior to taking responsibility as a facility employee if after October 1, 2018, or within 30 days of hire if prior to October 1, 2018. The Facility Employee Training Certificate shall contain accurate information for all employees trained. CORRECTIVE ACTION: Update the Facility Employee Training Certificate to contain the accurate information and submit a copy of the updated form to the EHD. This is a minor violation. 214 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION:According to the designated operator inspection report, a sensor was replaced on 8/7/2023.The EHD was not notified of the sensor replacement. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed,trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the sensor replacement. A"Failure to Obtain a Permit" penalty applies. This is a minor violation. 315 HSC 25290.1(e)Failure to maintain interstitial space to detect leaks before release to environment(post-Jul 2004). OBSERVATION: The UDC NR2 sensor failed when tested. REGULATION GUIDANCE: The interstitial space of the UST shall be maintained, as designed, under constant vacuum or pressure such that a breach in the primary or secondary containment is detected before the hazardous substance is released into the environment. CORRECTIVE ACTION: Correct immediately by having a properly licensed,trained, and certified contractor replace the failed component with a functional component(LG 113-x listed, if applicable), and obtain a permit within one business day from the EHD, if needed. If the failed component can't be replaced immediately,there is a possibility that the [GRADE] UST system may be red tagged to prevent fuel inputs. This is a repeat violation, Class II.
