Environmental Health Department SALJOAQUIN <br />4,1 —COUNTY— <br />.. qt g,,,41111:P'0,,e/ Greatness Vows here <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: J RUSSELL SHAFFER DISTRIBUTION INC Date: Nov 01, 2021 <br />RP Mailing Address: 1434 S WILLOW AVE <br /> Record ID#: CO6XWFOVS <br />RIALTO, CA 92376- Program Element: 2546 <br />Spill Location: WI 580 , TRACY <br /> Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />Approximately 40gallons of diesel was released from the saddle tank of a tractor trailer due to a single vehicle accident. <br />OBSERVATIONS: <br />On site for a single vehicle accident that released approximately 40 gallons of diesel from the saddle tank of the J Russell <br />Shaffer Distribution Inc tractor truck and met with Esther Herschbach of CALTRANS, Juan Armendarez Caltrans Hazmat <br />Manager and CHP officer Allen-21822. The diesel spill area was west bound, 1- 580, East of Mountain House Parkway at the <br />middle of 1-580 WB and 1-580 EB lanes. No Storm drain or water ways were impacted, soil was impacted. Dark diesel stains <br />were observed on site. When I talked to Ramon Leon/Malu (Responsible party representative) they had contacted Richard <br />Harbors Environmental Servicers for clean-up. <br />The impacted soil and area were being covered and secured with cones by Caltrans, Juan J. Armendarez, District Hazmat <br />Manager. Per Armendarez he will indicate the location of the incident to the clean-up company. At the time of incident, no <br />exact time and date was given as to when the clean-up will be completed.Remove all impacted soil and provide disposal <br />records of any waste generated from cleanup operations. <br />VIOLATIONS: <br />" Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />LI Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />IMMEDIATELY <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
