Hazelton Avenue <br /> Stockton, CA 95205 <br /> RE: CUPA Inspection Report <br /> Home Depot DC#5641 <br /> 1400 Pescadero Blvd. <br /> Tracy, CA 95304 <br /> Dear Mr. Garrett Backus: <br /> This letter is being provided on behalf of The Home Depot U.S.A., Inc.'s Tracy DC#5641 ("The Home Depot") <br /> and in response to the Hazardous Waste Inspection Report issued on December 12, 2022. The Home Depot <br /> has reviewed the Report and provides the following information in response to the alleged violations: <br /> 1. Failed to maintain complete hazardous waste training records. The business operator could not <br /> produce documentation during the inspection that demonstrates employees have complete <br /> hazardous waste training as specified in this section. <br /> RESPONSE: Distribution Center(DC)#5641 had access to its hazardous waste training records at the <br /> time of the inspection through a database on The Home Depot's intranet system. The Home Depot's <br /> Handling Hazardous Materials and Waste (HHM) Program requires associates to participate in hazcom <br /> training via ASAP.This program assists associates with recognizing chemical hazards in the workplace <br /> and how to ensure a safe workplace. All associates are required to complete the LQG training annually <br /> and Designated HHM associates are required to complete DHHM training annually. Database access <br /> has been reviewed with management to ensure accessibility during future inspections. <br /> 2. Failed to report program data in the California Environmental Reporting System (CERS). This <br /> business's complete hazardous waste activities have not been reported on the California <br /> Environmental Reporting System (CERS)website. <br /> RESPONSE: DC#5641 has reported its complete hazardous waste activities on the CERS website. <br /> The updated HMBP is enclosed for your review. <br /> 3. Failed to completely label containers or portable tanks of hazardous waste. One hazardous <br /> waste container was observed on-site without labeling. <br /> RESPONSE: The Home Depot's Handling Hazardous Materials and Waste (HHM) Program requires <br /> the DC to properly label hazardous waste containers. This aspect of the HHM Program has been <br /> reviewed with facility management to ensure properly container labeling going forward. The enclosed <br /> photograph shows the cited 5-gallon container for corrosive waste in the forklift battery area correctly <br /> labeled. A photograph is enclosed for your review. <br />
