SPCC plan <br />indicates training would be provided yearly to personnel. Facility failed could not provide proof of training at time of <br />inspection of the oil-handling personnel regarding the following: 1. The operation and maintenance of equipment to <br />prevent discharges. 2. Discharge procedure protocols. 3. Applicable pollution control laws, rules, and regulations. 4. <br />General facility operations. 5. The contents of the SPCC Plan. <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance <br />of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. <br />CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of <br />the training log and training content to the EHD. <br />This is a Class II violation. <br /> 621 CFR 112.7(f)(2) Failed to designate a person accountable for discharge prevention. <br />OBSERVATION: This facility does not have a designated person for discharge prevention. The 2013 SPCC plan, <br />the only SPCC plan available at the time of the inspection, indicated a person who is no longer the facility is the <br />designated person for discharge prevention. <br />REGULATION GUIDANCE: (f)(2) Designate a person at each applicable facility who is accountable for discharge <br />prevention and who reports to facility management. <br />CORRECTIVE ACTION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan shall designate a <br />person at the facility who is accountable for discharge prevention and who reports to facility management. <br />Designate a person accountable for discharge prevention, submit proof of correction to the EHD. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by July 7, 2022. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($152).
