Because of the special circumstances applicable to the property , including size , shape , topography , location , or surroundings , the <br /> strict application of the regulation deprives the property of privileges enjoyed by other property in the vicinity and under identical <br /> zoning classification . <br /> The property is in a unique location and surrounded by multiple parcels inconsistent with the AG40 zone . In fact , on the entire <br /> Assessor' s Page for this parcel , there is only one parcel in compliance . In other words 97 % of the parcels are currently less than <br /> zone minimum . <br /> To further add to the uniqueness , the " mother" parcel of the existing parcel was initially just under 40 acres and the current <br /> parcel was reduced in size from the larger parcel because a County road bisected the mother parcel . <br /> 2 . The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations upon other properties <br /> in the vicinity and zone in which the property is situated . <br /> Granting of a Variance would not create a "fish out of water" parcel . Rather it would allow a parcel consistent with 97 % of the <br /> properties in the immediate vicinity . <br /> Secondly , the Planning Commission has previously approved Variances for factural situations similar to this ( PA- 140007 and <br /> PA- 1800216 ) <br /> 3 . The Variance will not authorize a use or activity which is not otherwise expressly authorized by the regulation governing the parcel <br /> of property . <br /> The Variance is for lot size only and would not authorize a use or activity which is not otherwise authorized by the regulation <br /> governing this property . <br /> Paye 3 of 4 <br /> Updated 091115 / 2020 ` <br />
