SAN JOAQUIN <br /> Environmental Health Department <br />COUN F Y <br />Greosi,ess g;ov.i here <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: Date: Dec 29, 2021 <br /> <br />RP Mailing Address: 302 KELLY MIST CT <br />Record ID#: COKUZOGKR <br /> <br />TRACY, CA 95377- <br />Program Element: 2546 <br />Spill Location: 302 KELLEY MIST CT, TRACY <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />While changing the oil on a vehicle 15 quarts of diesel, of that 10 quarts were removed with dry absorbents and remaining 5 <br />quarts was washed into a storm drain with a hose, <br />OBSERVATIONS: <br />EHD received a spill notification of approximately 15 quarts of diesel released while changing the oil of a vehicle, 5 quarts <br />was washed into a storm drain and 10 quarts removed with absorbent pads . <br />On site met with Larry Vicker, Andy Sanasaver, of Tracy Fire Department Battalion 9, Officer Huvnh, Tracy PD and Ana <br />Contreras, Tracy Code enforcement. Per Larry Vickers they stopped the fire in a 55 gallon steel drum burning absorbent <br />pads. Observed dark oily stains on the driveway concrete and two 55 gallons, blue steel drums with diesel (approximately <br />20 gallons each). The 5 quarts of diesel/oil spill went to the street gutter leading to the storm drain, approximately <br />300-500ft trail. The City of Tracy power washed, degrease and vacuumed the gutter with a hose from the driveway <br />towards the storm drain. <br />The liquids retrieved from the gutter/storm drain will be disposed of as hazardous waste.As per Wayne Bogart, Public works <br />City of Tracy supervisor further storm drain cleaning is not required. <br />Due to observed dark oily stains on the driveway sidewalk, clean up all released material and dispose of it under all <br />appropriate waste manifesting and waste disposal laws and regulations. Make a hazardous waste determination for all <br />waste materials and dispose of them as required. Provide proof of correction and copies of disposal records of any waste <br />generated from cleanup operations to EHD. <br />Please be advised that the disposal of any waste [HSC 5411] or disposal of any hazardous waste, or the causing therefor, is <br />prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. <br />[HSC25189.5(a)] <br />Immediately provide a written statement documenting the corrective action or measures that you put in place to minimize the <br />potential for future release. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />° Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />° Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />ICORRECTIVE ACTIONS / ORDER: <br />WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE EHD 25-01 Rev. 9/16/2020 Page 1 of 2 <br />1868 E.
