SAN JOAQUIN <br />COUNTY <br />amlas • <br /> <br />,sorey reatnass grows 14, <br />Environmental Health Department <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: CHARLES HENRY VINEYARD Date: Oct 31, 2022 <br />RP Mailing Address: 24608 PATRICIA CT <br />Record ID#: COOFHH8ET <br />HAYVVARD, CA 95451- <br />Program Element: 2546 <br />Spill Location: , STOCKTON <br />Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />On October 28, 2022 at approximately 1:55pm, San Joaquin County Environmental Health (EHD) received notification that a <br />18-20 feet pleasure craft was partially submerged due to unknown reasons caused a sheen size of approximately 30 yard <br />long x 5 feet at LAT 37.97157 N LONG -121.51233W, City of Stockton. <br />OBSERVATIONS: <br />EHD made contacts with the department of Fish and Wildlife. It is unknown why the vessel sank and it discharged gasoline <br />into the middle river causing a sheen. The release is not stopped and not contained with waterways impacted. <br />Stop the release, secure the area and cleanup the impacted area. Profile the released material and send test results to <br />EHD. Proceed with the cleanup immediately and notify EHD. Make a hazardous waste determination for any generated <br />hazardous waste material from the clean up operation and dispose of them as required and provide results and disposal <br />records to EHD. <br />Please be advised that the disposal of any waste [HSC 54111 or disposal of any hazardous waste, or the causing therefor, is <br />prohibited when the disposal is at a facility that is not permitted or authorized for hazardous waste disposal. <br />[HSC25189.5(a)]. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />" Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />CORRECTIVE ACTIONS / ORDER: <br />Investigate and abate contamination under the oversite of the appropriate lead agency. <br />Submit copies of hazardous waste manifests/disposal records to the EHD. <br />Other Correction <br />Immediately. <br />EHD 25-01 Rev. 9/16/2020 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE Page 1 of 2 <br />1868 E.
