23IN000195
Narrative
GKH Global Services
HXIL9354 arrived at the destination hub- BNSF Stockton CA on 1/17/23, & was observed actively leaking a bright yellow paint like material on the
railcar & along the side/underneath the trailer. The release was dripping at various rates & has released a total less than 4 gallons collectively. The trailer
was immediately moved to the containment pit, with an environmental contractor dispatched to clean all affected areas.
*IMPORTANT*
As such, this is a shipper responsibility for improper loading/handling/securing cargo & the remediation costs are the responsibility of GKH Global
Services. Contact Patriot Environmental at 800-624-9136 & reference HXIL9354 1/17/23 Stockton, CA for payment.
Patriot found 10-20gals missing from a 55 gal drum of Sherwin Williams Dynaprime primer, UN1263 (Hazmat). An additional drum had a 2" break/crack
in the bottom & released 50gals of same primer. There was also 11 pallets of Revista Surfactant, Hazmat UN3082, that was not declared/placarded
either.
All areas were cleaned & cargo was reloaded. Patriot Env'l removed all waste materials on behalf of GKH Global Svcs. Review this with the origin &
ensure future shipments comply with BNSF rules.
Ancillaries
In accordance with BNSF's Intermodal Rules and Policies Guide, ancillary charges may apply to this shipment. An invoice, if applicable, will be
generated to the shipper upon completion of the incident review.
Leaker Disclaimer
In addition, please be advised that some counties in the State of California will send BNSF Railway an invoice for their activity/handling/response
charges associated with a leaking shipment. It is not uncommon for BNSF Railway to receive these invoices several months after incident occurrence,
which will be promptly submitted to the appropriate shipper for payment. The shipper should contact the issuing county if they have any questions
regarding the invoice charges.
NOTE: With these current critical times in our transportation industry, I ask that you ensure your equipment is in acceptable condition & remind
everyone to secure all cargo properly per BNSF requirements. Also do not exceed the weight limit of a shipment as outlined in the BNSF IR & PG.
Failing to do so may result in accidents, injuries &/or unnecessary damage/delays to these or other shipments we move.
Sincerely,
John Brainard
Load and Ride Solutions Manager
BNSF Railway
6540 S. Austin Rd.
Stockton, CA 95215
209-460-6061 office
john.brainard©bnsf.com
Important Information
All loss and damage should be documented via photos (taken inside the container/railcar where possible) and appropriate receiving records (including
security seal documentation) at the time of opening/unloading/inspection by the receiver. For information and requirements on filing a cargo claim go to
rittp://www.bnsf.com/shio-with-bnsf/su000rt-services/cargo-loss-and-damage-claims.html,
For information on filing Intermodal equipment loss/damage claims please contact BNSF Intermodal Equipment Maintenance at
IABUDLIBUEQDMGINV@BNSF.com or 1-800-446-6554, option 1.
Reportable railcar damage will be reported to car owners via the Damage and Defective Car Tracking (DDCT) system. All communication and
transactions for railcar repair should be handled through DDCT.
All claims are evaluated based upon merit.
2
