SAN J OAQU I N Environmental Health Department <br /> CC LJ N T AMENDED <br /> 3/13/2023 <br /> Aboveground Petroleum Storage Act Inspection Report <br /> Facility Name: Facility Address: Date: <br /> FLYING J TRAVEL PLAZA#617 1 15237 N Thornton Rd, Lodi March 09, 2023 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 203 CFR 112.3 Failure to implement the SPCC Plan. <br /> OBSERVATION 1: The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented as <br /> required.The plan requires the facility to conduct annual inspection under SP001 standards. The facility was not <br /> conducting annual inspections. <br /> OBSERVATION 2: Per Table 3-1, "Summary of Facility Inspection Schedule",the facility has several quarterly <br /> inspections required through the year. The facility has a"Regional Facility Services(RFS)Quarterly Maintenance <br /> Walkthrough Form"in appendix B for several inspections. Per General Manager Matt Duce, the form in the plan is <br /> outdated and a different one is used. <br /> REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section <br /> must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan" <br /> or"Plan")," in accordance with § 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator shall <br /> conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section <br /> 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill <br /> prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the <br /> regulations contained in Part 112(commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the <br /> Code of Federal Regulations. <br /> CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. <br /> This is a Class II violation. <br /> 610 CFR 112.7(a)(3vi), 112.7(a4)Plan failed to adequately detail information and procedures for reporting a discharge. <br /> OBSERVATION: The Spill Prevention, Control, and Countermeasure(SPCC) Plan does not adequately discuss <br /> procedures for reporting a discharge. <br /> The San Joaquin County CUPA phone number was incorrectly written in Table 2-4. Emergency Spill Contacts. The <br /> phone is monitored 24 hours and the correct number is 209-468-3420. <br /> REGULATION GUIDANCE: The SPCC plan shall include: (vi)Contact list and phone numbers for the facility <br /> response coordinator, National Response Center, cleanup contractors with whom you have an agreement for <br /> response, and all appropriate Federal, State, and local agencies who must be contacted in case of a discharge as <br /> described in § 112.1(b). <br /> (4)Unless you have submitted a response plan under§ 112.20, provide information and procedures in your Plan to <br /> enable a person reporting a discharge as described in § 112.1(b)to relate information on the exact address or <br /> location and phone number of the facility;the date and time of the discharge,the type of material discharged; <br /> estimates of the total quantity discharged; estimates of the quantity discharged as described in§ 112.1(b);the <br /> source of the discharge; a description of all affected media;the cause of the discharge; any damages or injuries <br /> caused by the discharge; actions being used to stop, remove, and mitigate the effects of the discharge;whether an <br /> evacuation may be needed; and, the names of individuals and/or organizations who have also been contacted. <br /> This was corrected on site. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> FA0012979 PR0536558 SCO01 03/09/2023 <br /> EHD 28-01 Rev.12/06/2021 Page 5 of 6 Aboveground Petroleum Storage Act OIR <br /> 1868 E.
