SANsJOAQUIN <br /> Environmental Health Department <br />COUNTY <br />WASTE DISCHARGE/SPILL RESPONSE <br />NOTICE TO ABATE <br />Responsible Party: TTS LLC <br /> Date: Apr 18, 2022 <br />RP Mailing Address: 11000 FRISCO ST STE 100 <br /> Record ID#: COCUSDOMO <br />FRISCO, TX 75033- Program Element: 2546 <br />Spill Location: 1012 E ROTH RD, FRENCH CAMP Release/Spill Response (excluding Joint Team) <br />NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br />25 gallons of printer ink leaked from a conex box. <br />OBSERVATIONS: <br />Patriot Environmental Services (Patriot) was hired to clean the spill. Arrived on site and confirmed final cleanup of concrete <br />and soil. Patriot was still in the process of cleaning the conex box. No storm drains or waterways were observed affected <br />by the release. Per Mike Algots, Union Pacific, the waste will be taken to the Stockton Yard at 833 E Eighth St to be profiled <br />and properly disposed of. <br />Cleanup was completed on same day by Patriot after site visit. Two 55 gallon drums of waste were generated. <br />VIOLATIONS: <br />Discharge of any waste, including sewage <br />(CA Health and Safety Code 5411) <br />Discharge of waste or sewage to water or within 150 ft. of waterway <br />(SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br />c Improper disposal of a hazardous waste <br />(CA Health and Safety Code 25189.5) <br />Permitting or Maintaining a Nuisance <br />(SJC Ordinance Code Section 8-5100) <br />Other Violation <br />VIOLATION: Failed to make a hazardous waste determination. <br />OBSERVATION: Two 55 gallon drums of printer ink waste were generated and taken to the Union Pacific Yard at 833 <br />E Eighth St, Stockton for profiling and disposal. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as <br />specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous wastes. <br />There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or ignitable. <br />Title 22 CCR section 66261.2 — Definition of Waste <br />Title 22 CCR section 66261.3 — Definition of Hazardous Waste <br />A business operator shall keep records of any hazardous waste determinations made in accordance with Title 22 <br />California Code of Regulations (CCR) section 66262.11 for at least three years from the date that the waste was last <br />sent to an on-site or off-site treatment, storage, or disposal facility.
