The following is an itemized list of hazardous materials violations that have not been <br />addressed for HARVEST CROSSING POST ACUTE as of March 15, 2023. <br />Open violations from October 27, 2022 inspection <br />Violation #9 - Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. <br />-The 2020, 2021 and 2022 business plan submittal was not submitted. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br /> <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Violation #10 - Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: During the inspection, it was stated that the primary emergency contact name and phone number <br />is not current. The business has not updated or reported to the California Environmental Reporting System (CERS). <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material. <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d) Change business ownership <br /> e) Change of business name <br /> f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the <br />business plan. <br /> (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or <br />impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Page 2 of 2
