SAN JOAQUIN Environmental Health Department ----COUNTY Time In: 1:11 pm Time Out: 1:27 pm COMPLAINT INSPECTION REPORT Name of Facility: NEW INDIAN SUPERMARKET Date: 03/09/2023 Address: 3250 N TRACY BLVD, TRACY 95376 Owner/Operator: SHARDA, SANJEEV Telephone: (209) 237-2939 Program Element: 1600- FOOD PROGRAM Complaint #: C00055640 Responsible Party Contact: DESCRIPTION OF COMPLAINT ALLEGATIONS The San Joaquin County Environmental Health Department received the following complaint: C00055640 states: "COMPLAINANT'S WIFE BOUGHT COOKIES FOR HER 7 YEAR OLD DAUGHTER IN PREPACKAGED FOOD CONTAINER WITH NO INGREDIENT LIST OR INFORMATION ON IT. THE DAUGHTER HAD AN ALLERGIC REACTION (ALLERGIC TO NUTS) AND HAD TO USE EPI-PEN. COMPLAINANT IS WORRIED THAT SOMEONE ELSE WILL GET HURT BECAUSE NONE OF THE FOODS HAVE LABELS ON THEM. FOOD IS LOCATED TO THE RIGHT OF THE REGISTERS." VIOLATIONS AND CORRECTIVE ACTIONS Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code commencing with section 7; 113700. All violations must be corrected within specified timeframe. Violations that are classified as "MAJOR" pose an immediate threat to public health and have the potential to cause foodbome illness. All major violations must be corrected immediately. Non-compliance may warrant immediate closure of the food facility. #32 Food Properly Labeled and Honestly Presented OBSERVATIONS: Observed pre-packaged containers of cookies from Singh bakery and pre-pakaged roti (Doaba) that lack proper labeling. Pre-packaged food shall be labeled with the following information: 1) the common name of the food, 2) a list of ingredients (in descending order of predominance by weight including a declaration of artificial colors or flavors and chemical preservatives, 3) an accurate declaration of the quantity (weight) of the contents, and 4) the name and place of business of the manufacturer, packer, or distributor. Correct today. CAL CODE DESCRIPTION: Any food is misbranded if its labeling is false or misleading, if it is offered for sale under the name of another food, or if it is an imitation of another food for which a definition and standard of identity has been established by regulation. Food facilities with 19 or more chains in the state shall disclose nutritional information. We discussed the complaint. Observed some pre-packaged cookies from Singh Bakery (Sacramento) that lack proper labeling. In addition, observed some roti from Doaba (same owner as supermarket) that lack proper labeling. See Item #32. Owner states he will call Singh Bakery in Sacramento and alert them of the labeling requirements.
