Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: COTGGKZ9Z Site Location: NB 1-5 RAMP TOWARDS EB ST RTE 120 <br />Activity Summary <br />Activity Date Recorded by <br />07/13/2021 Received a phone call from Juan Armendarez (CALTRANS). Juan stated that the MURO <br />responsible party was also disputing billing with CALTRANS for the cleanup. Juan <br />will be emailing hazardous materials spill and responsible party information to the <br />responsible party and asked if he can have a copy of the Notice to Abate and he <br />will CC me in the email response to the responsible party. <br />09/23/2021 Reviewed complaint in preparation for abatement procedure. Gathered documents MURO <br />and generated list of items still required for abatement. <br />12/27/2021 Emailed a reply to the email thread containing insurance agent, cleanup MURO <br />contractor, Caltrans personnel copied with the responsible party:Jose Diaz (Diaz <br />Transport) requesting disposal records. <br />Recipients: norms@anconservices.com; Jason Morgan <br /><jasonmo@anconservices.com>: Manzo, Elena K. [EHD] <br /><emanzo@sjgov.org>Armendarez, Juan J@DOT <br /><juan.armendarez@dot.ca.gov>; ngyore@nationalclaims.net; <br />poncho2000@live.com <br />01/04/2022 Called Norman Sanchez (Ancon Services) 916-581-9982. Provided spill location MURO <br />and details to Norman and requested disposal records. Norman recalled which <br />spill I was inquiring about and stated he will be contacting their staff in the waste <br />department and will provide a manifest. <br />01/04/2022 Added details to daily dated 06-17-2021 not previously added. MURO <br />01/14/2022 Called Alejandro Samano (Ancon Services) at 510-292-8099 inquiring about the <br />disposal record for the waste generated from cleanup. Provided date and location, <br />and Alejandro was able to recall the cleanup. Alejandro stated that the waste <br />might still be at the location where they took it following cleanup. <br />Received a call from Norman Sanchez (Ancon Services) who stated that they <br />have not picked up the 20 yard bin because they have been having trouble <br />obtaining the responsible party signature. He reported the bin was still stored at <br />the place it was taken to on the day it was generated. <br />MURO <br />01/14/2022 Complaint file preparation for abatement. Printed complaint documents. Retrieved MURO <br />photos from cleanup for photo log. Generated final photo log. <br />01/20/2022 Called Juan Armendarez (CALTRANS) and discussed current status of complaint MURO <br />with him. Juan reported that the reason Ancon has not disposed of the waste is <br />due to not being able to obtain a signature from the responsible party, or <br />authorization for Ancon to sign on the responsible party's behalf. Juan suggested I <br />reach out to Nicholas Gyore with National Claims Management who is <br />representing the responsible party. <br />01/25/2022 Called Nicholas Gyore in Oregon, 503-636-1266 but received message that the <br />business closed at 4:30. Sent email to Nicholas Gyore letting him know that all <br />efforts obtaining the requested documentation to abate the complaint is billed. <br />Discussed in the email what was detaining the contractors from disposing of the <br />waste and what is still needed to abate the complaint. <br />MURO <br />5105. rpt <br />Page 4 of 5
