Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />April 06, 2023 <br /> Facility Address: <br /> 840 N Sacramento St, Lodi <br /> Facility Name: <br /> Airgas USA, LLC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted <br />late on 1/17/2022 for calendar year 2022 and on 2/14/2023 for calendar year 2023. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Corrected on-site. Juan Garibay submitted statements stating that the business plan will <br />be submitted by January 15 due date. <br />This is a minor violation. <br /> 10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: Jeff Hauteman stopped working for the facility on 10/2022. Jeff has been listed as the alternate <br />emergency coordinator on page 2 of the CERS Consolidated Emergency Response/ Contingency Plan. The <br />business has not updated and submitted the information within 30 days of the change. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material. <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d) Change business ownership <br /> e) Change of business name <br /> f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the <br />business plan. <br /> (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, <br />or impede implementation of the business plan. <br />CORRECTIVE ACTION: Corrected at the time of the inspection. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were two violations during the <br />inspection.
